HB 361 -- DNA PROFILING SPONSOR: Lipke COMMITTEE ACTION: Voted "do pass by consent" by the Committee on Judiciary by a vote of 13 to 0. This bill exempts traffic violation cases from the $15 surcharge assessed as court costs and deposited into the DNA Profiling Analysis Fund. This fund pays for the collection and analysis of DNA profiles of persons convicted of a felony or sex crime. Currently, a $30 surcharge is assessed upon all felony convictions and a $15 surcharge upon all misdemeanor convictions, which includes traffic offenses. FISCAL NOTE: No impact on state funds in FY 2006, FY 2007, and FY 2008. PROPONENTS: Supporters say that the bill specifies that traffic offenses are not subject to the $15 surcharge for DNA profiling. Testifying for the bill were Representative Lipke; and Office of State Courts Administrator. OPPONENTS: There was no opposition voiced to the committee.
