Summary of the Committee Version of the Bill

HCS HB 362 -- EXPUNGEMENT

SPONSOR:  Byrd (Lipke)

COMMITTEE ACTION:  Voted "do pass by consent" by the Committee on
Judiciary by a vote of 12 to 0.

This substitute specifies that when records of an alcohol-related
driving offense or an arrest record are ordered expunged by the
court the records and files maintained in any administrative,
associate circuit court, or circuit court proceeding are
confidential and only available to the parties or by order of the
court for good cause shown.

FISCAL NOTE:  No impact on state funds in FY 2006, FY 2007, and
FY 2008.

PROPONENTS:  Supporters say that the bill clarifies that civil
filings are closed records and makes procedures consistent in
civil and criminal cases.

Testifying for the bill were Representative Lipke; and Office of
State Courts Administrators.

OPPONENTS:  Those who oppose the bill say that they oppose the
closing of records.

Testifying against the bill was Missouri Press Association.
