HB 700 -- ENDANGERMENT OF INDIVIDUALS AT CORRECTIONAL FACILITIES

SPONSOR:  Moore

COMMITTEE ACTION:  Voted "do pass" by the Committee on
Corrections and Public Institutions by a vote of 7 to 0.

This bill makes it a class C felony for any person held in a
correctional setting within this state who is knowingly infected
with HIV, hepatitis B, or hepatitis C to intentionally cause
another person to come into contact with any of their bodily
fluids.

FISCAL NOTE:  No impact on state funds in FY 2006, FY 2007, and
FY 2008.

PROPONENTS:  Supporters say that these types of actions can be
life threatening.  The Department of Corrections has had 146
incidents where inmates have thrown bodily fluids on staff.  In
states where the penalty has increased to a felony, the incidents
have decreased significantly.

Testifying for the bill were Representative Moore; and Department
of Corrections.

OPPONENTS:  There was no opposition voiced to the committee.
