Summary of the Introduced Bill

HB 763 -- Drug Court Commissioner and Administrator

Sponsor:  Kuessner

This bill allows the 42nd Judicial Circuit to appoint a drug
court commissioner and a drug court administrator.  The bill:

(1)  Allows the commissioner to receive the same compensation and
retirement benefits as an associate circuit judge;

(2)  Allows the administrator to receive the same compensation
and benefits as other circuit court personnel;

(3)  Allows the circuit judge to reject or confirm any order,
judgment, or decree by the commissioner;

(4)  Requires the commissioner and administrator to be appointed
to a four-year term, by a majority of the court en banc;

(5)  Prohibits the commissioner from engaging in the private
practice of law; and

(6)  Allows the commissioner or administrator to be removed from
office upon the showing of misconduct, habitual drunkenness,
willful neglect of duty, corruption in office, incompetency,
moral turpitude, oppression in office, or unsatisfactory
performance of duties.

The bill contains an emergency clause.
