AN ACT
To amend chapter 565, RSMo, by adding thereto one new section relating to crimes of violence against children and the elderly, with a penalty provision.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 565, RSMo, is amended by adding thereto one new section, to be known as section 565.320, to read as follows:
565.320. 1. As used in this section the following terms shall mean:
(1) "Child", a person under seventeen years of age;
(2) "Crime of violence", any crime which involved the threat or use of physical force against a child or elderly person;
(3) "Elderly", a person sixty-five years of age or older.
2. Notwithstanding any other provision of law no court shall sentence a person who has pled guilty or nolo contendere to or has been convicted of a crime of violence against a child or the elderly to a term of imprisonment of less than thirty consecutive days or to pay a fine in lieu of a term of imprisonment, nor shall such person be eligible for parole or probation until he or she has served a minimum of thirty consecutive days of imprisonment.
