AN ACT

To amend chapter 393, RSMo, by adding thereto one new section relating to electrical energy corporations with an emergency clause.





Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 393, RSMo, is amended by adding thereto one new section, to be known as section 393.157, to read as follows:

            393.157. As a part of a general rate proceeding in which the commission considers all relevant factors, which may affect the costs or overall rates and charges of an electrical corporation, as defined in section 386.020, RSMo, the commission may authorize such an electrical corporation to recover, subject to refund with interest at the electrical corporation's short-term rate, all or a portion of its reasonably and prudently incurred costs for fuel delivered to its generating stations, including the transportation thereof, and all or a portion of its reasonably and prudently incurred costs for its purchased electrical energy for its retail customers under an interim energy charge or other specific and separate interim charge or surcharge. Any such fuel and purchased electrical energy costs not so recovered shall be recovered through the electrical corporation's permanent base rates. This section is enacted in part to clarify and specify the law existing prior to the effective date of this section.

            Section B. Because immediate action is necessary to ensure that the interests of electrical corporations and their customers are well-served the enactment of section 393.157 of section A of this act is deemed necessary for the immediate preservation of the public health, welfare, peace, and safety, and is hereby declared to be an emergency act within the meaning of the constitution, and the enactment of section 393.157 of section A of this act shall be in full force and effect upon its passage and approval.
