AN ACT

To amend chapter 303, RSMo, by adding thereto one new section relating to uninsured motorists, with a penalty provision.





Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 303, RSMo, is amended by adding thereto one new section, to be known as section 303.035, to read as follows:

            303.035. 1. The owner or operator of every uninsured motor vehicle which is involved in an accident within this state, upon the streets or highways thereof, or on any publicly or privately owned parking lot or parking facility generally open for use by the public, in which any person is killed or injured or in which any person sustained property damage, other than himself or herself, shall pay restitution to such other person or persons, in an amount equal to the insurance deductible of any other person or persons involved in the accident and shall within ninety days of the date of such accident file proof with the director that such restitution has been paid in full.

            2. If within ninety days of the date of the accident, the director does not have on file satisfactory evidence that the owner or operator of the uninsured motor vehicle who is required to pay restitution pursuant to subsection 1 of this section has paid such restitution, then the director shall suspend the license of the owner or operator of the uninsured motor vehicle; provided that notice of such suspension shall be sent by the director to such owner or operator not less than ten days prior to the effective date of such suspension and shall state the total amount of restitution required to be paid. The suspension provided for in this section shall be in addition to any period of suspension imposed under section 303.030. The suspension shall remain in effect until such time as the owner or operator of the uninsured motor vehicle files proof of payment in full with the director as required pursuant to subsection 1 of this section.

            3. The director shall reinstate the license of any owner or operator whose license was suspended pursuant to the provisions of this section upon the filing of proof of payment in full with the director.

            4. Any person who violates the provisions of subsection 1 of this section is guilty of a class B misdemeanor and any person who receives a suspended imposition of sentence or suspended execution of sentence for this offense shall as a part of any probation, whether supervised or unsupervised, be ordered to pay the restitution required in subsection 1 of this section.
