AN ACT

To amend chapter 191, RSMo, by adding thereto one new section relating to hepatitis C testing.





Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 191, RSMo, is amended by adding thereto one new section, to be known as section 191.645, to read as follows:

            191.645. 1. The department of health and senior services shall establish and oversee a voluntary hepatitis C annual testing program for health care providers. The employer of the health care provider shall pay the cost of such testing.

            2. Any test results obtained from such testing shall be confidential and shall not be disclosed except to any health care facility where the health care provider provides patient care. The department may only notify such facilities of the practice restrictions and limitations imposed on such health care provider. Such restrictions and limitations shall only be disclosed to those persons employed at the health care facility who have a reasonable need to know such information.

            3. Notwithstanding the voluntary nature of the hepatitis C testing authorized under this section, the department of health and senior services may exercise the general authority and power under section 192.020, RSMo, to intervene in instances where there is reason to believe that a health care provider is practicing in a manner that creates a grave and unjustifiable risk of injury to others.
