AN ACT
To repeal sections 321.017 and 321.190, RSMo, and to enact in lieu thereof two new sections relating to fire protection districts.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Sections 321.017 and 321.190, RSMo, are repealed and two new sections enacted in lieu thereof, to be known as sections 321.017 and 321.190, to read as follows:
321.017. Notwithstanding the provisions of section 321.015, no employee of any fire protection district or ambulance district shall serve as a member of [any] the fire district or ambulance district board while such person is employed by [any] the fire district or ambulance district, except that an employee of a fire protection district or an ambulance district may serve as a member of a voluntary fire protection district board or a voluntary ambulance district board. If an employee of a fire protection district or ambulance district resides in a fire protection district or ambulance district other than the district for which the employee works, the employee may serve as a member of the fire protection district board or ambulance district board for the district in which the employee resides.
321.190. Each member of the board may receive an attendance fee not to exceed one hundred dollars for attending each regularly called board meeting, or special meeting, but shall not be paid for attending more than [two in any calendar month, except that in a county of the first class having a charter form of government, he shall not be paid for attending more than four in any calendar month] one per calendar week. In addition, the chairman of the board of directors may receive fifty dollars for attending each regularly or specially called board meeting, but shall not be paid the additional fee for attending more than [two meetings in any calendar month] one meeting per calendar week. Each member of the board shall be reimbursed for his or her actual expenditures in the performance of his or her duties on behalf of the district. In addition, each member of the board shall receive up to seventy-five dollars per day, to be determined by the board, for each day the member is engaged in official business of the board. The secretary and the treasurer, if members of the board of directors, may each receive such additional compensation for the performance of their respective duties as secretary and treasurer as the board shall deem reasonable and necessary, not to exceed one thousand dollars per year. The circuit court having jurisdiction over the district shall have power to remove directors or any of them for good cause shown upon a petition, notice and hearing.
