Summary of the Committee Version of the Bill

HCS HB 1322 -- DNA PROFILING ANALYSIS

SPONSOR:  Lipke

COMMITTEE ACTION:  Voted "do pass" by the Committee on Crime
Prevention and Public Safety by a vote of 12 to 0.

This substitute defines "central repository" and "forensic DNA
analysis" and allows a person determined to be actually innocent
of a crime to receive $50 for each day of post-conviction
incarceration and an automatic expungement of any records
concerning the crime for which the person was innocent.

The substitute also changes the expiration date on criminal court
surcharges from August 28, 2006, to August 28, 2013.

FISCAL NOTE:  Estimated Cost on General Revenue Fund of $0 to
Unknown in FY 2007, FY 2008, and FY 2009.  No impact on Other
State Funds in FY 2007, FY 2008, and FY 2009.

PROPONENTS:  Supporters say that due to a loophole in current
statutes, there are a handful of individuals who are not eligible
for restitution payments.  Many exonerated individuals suffer
from post-traumatic stress syndrome and once released from
incarceration do not have a plan or program to help them re-enter
mainstream society.

Testifying for the bill were Representatives Lipke and
Johnson (61); Stephen Toney; Milton Stose; and Missouri Catholic
Conference.

OPPONENTS:  There was no opposition voiced to the committee.
