HCS HB 1559 -- DONATION OF CANNED OR PERISHABLE FOOD SPONSOR: Roark (Cunningham, 86) COMMITTEE ACTION: Voted "do pass by consent" by the Special Committee on General Laws by a vote of 6 to 0. This substitute adds grocery and convenience stores to the list of donors that in good faith can donate any canned or perishable food to a bonafide charity or nonprofit organization for free distribution without being subject to a criminal penalty or civil damages arising from the condition of the food, unless an injury is caused by the gross negligence, recklessness, or intentional misconduct of the donor. FISCAL NOTE: No impact on state funds in FY 2007, FY 2008, and FY 2009. PROPONENTS: Supporters say that the bill will allow businesses to give away good food without the worry of liability just as restaurants currently are allowed.
