Summary of the Committee Version of the Bill

HCS HB 1559 -- DONATION OF CANNED OR PERISHABLE FOOD

SPONSOR:  Roark (Cunningham, 86)

COMMITTEE ACTION:  Voted "do pass by consent" by the Special
Committee on General Laws by a vote of 6 to 0.

This substitute adds grocery and convenience stores to the list
of donors that in good faith can donate any canned or perishable
food to a bonafide charity or nonprofit organization for free
distribution without being subject to a criminal penalty or civil
damages arising from the condition of the food, unless an injury
is caused by the gross negligence, recklessness, or intentional
misconduct of the donor.

FISCAL NOTE:  No impact on state funds in FY 2007, FY 2008, and
FY 2009.

PROPONENTS:  Supporters say that the bill will allow businesses
to give away good food without the worry of liability just as
restaurants currently are allowed.

Testifying for the bill were Representative Cunningham (86); and
Missouri Grocers Association.

OPPONENTS:   There was no opposition voiced to the committee.
