Summary of the Committee Version of the Bill

HB 1857 -- COMMENCEMENT OF PROSECUTION

SPONSOR:  Lipke

COMMITTEE ACTION:  Voted "do pass by consent" by the Committee on
Crime Prevention and Public Safety by a vote of 12 to 0.

This bill specifies that a prosecution is commenced for a
misdemeanor or infraction when the information is filed.  A
prosecution for a felony is commenced when the complaint is
filed.

FISCAL NOTE:  No impact on state funds in FY 2007, FY 2008, and
FY 2009.

PROPONENTS:  Supporters say that in current law there are statute
of limitations problems for prosecutors filing felony charges.
The bill corrects those problems.

Testifying for the bill were Representative Lipke; and Eric Zahnd
and Bob McCulloch, Missouri Association of Prosecuting Attorneys.

OPPONENTS:  There was no opposition voiced to the committee.
