HB 1031 -- Leaving a Child in a Motor Vehicle Sponsor: Threlkeld This bill creates the crime of leaving a child unattended in a motor vehicle in the third degree. Currently, there is a first and second degree for the offense. The offense is committed in the third degree when a child 10 years of age or younger is left unattended in a motor vehicle and the child's health or safety is at risk, the engine is running, or the keys are anywhere in the passenger compartment of the vehicle.
