Summary of the Introduced Bill

HB 1906 -- Criminal Investigation and Prosecution Costs

Sponsor: Viebrock

This bill requires convicted persons or persons who pled guilty
or are found guilty to pay the documented costs resulting from
the prosecution and investigation of their offense. Defendants
must pay the costs no later than the end of their probation or
parole period, five years after the end of their term of
imprisonment, or five years after the date of their sentencing.
The defendant's obligation will not end if the costs are not paid
in full by the specified time. Payment of prosecutorial and
investigative costs will be a condition of probation or parole.
Any non-repayment may be cause for revocation of the defendant's
probation or parole if a court finds, by a preponderance of the
evidence, that the defendant's non-repayment was willful,
intentional, and without sufficient bonafide efforts.
