AN ACT
To repeal section 37.250, RSMo, and to enact in lieu thereof three new sections relating to the Homeland Security.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Section 37.250, RSMo, is repealed and three new sections enacted in lieu thereof, to be known as sections 26.230, 34.169, and 650.037, to read as follows:
26.230. 1. The governor shall annually perform a spending analysis of all monies provided for homeland security and shall reduce the results of such analysis to writing in the form of a homeland security spending analysis report.
2. The homeland security spending analysis report shall be submitted annually to the legislature in December of each year. The report shall include a detailed listing of all monies received and all monies spent for homeland security.
34.169. All purchases made by the commissioner of administration for wireless communication products for public safety shall meet the standards set forth by the public safety communications committee for wireless communications programs.
650.037. 1. This section shall be known and may be cited as the "Missouri Uniform Communications Act for Homeland Security".
2. The general assembly resolves that it is the public policy of this state to promote effective, ubiquitous, and interoperable public safety communications in real time and on demand between all personnel of all state and local agencies, and the development of necessary communications capabilities and procedures needed to provide assured emergency response, and to minimize the response time for first responders to emergency or disastrous situations.
3. There is hereby created the "Public Safety Communications Committee", to be composed of:
(1) The director of the department of public safety or the director's designee;
(2) The director of the office of homeland security or the director's designee;
(3) The director of the department of conservation or the director's designee;
(4) The director of the department of transportation or the director's designee;
(5) The president of the Missouri Fire Chiefs Association; and
(6) The president of the Missouri Sheriffs Association.
4. All public safety agencies, including any local, state, or other political subdivision, which provides public safety services or emergency services, including but not limited to fire protection, law enforcement, emergency medical services, or other emergency response services for public safety or public service, shall submit a plan to the committee for approval when requesting state funds or federal funds disbursed by the state for wireless communication programs.
5. The committee shall examine all funding requests for wireless communications programs and proposals to identify and evaluate interoperability. Requisite interoperability elements shall be included if proposals are to receive further consideration.
6. The committee shall draw upon Missouri's state interoperability executive committee, as recognized by the Federal Communication Commission, to make recommendations as it deems appropriate to maintain and enhance interoperable public safety wireless communications.
7. Any state or federal funds used to make purchases not in compliance with the plan approved by the public safety communications committee may be subject to civil sanctions by the committee, including repayment of funds to the state.
[37.250. 1. The general assembly declares it is the public policy of this state to determine the most cost-effective systems to provide ubiquitous coverage of the state transparent communications between all members of all using agencies, and the necessary E911 capability to provide assured emergency response, and to reduce the response time for emergency or disastrous situations.
2. There is hereby created a committee on state-operated wireless communication systems to be composed of:
(1) The commissioner of administration or a designee;
(2) The director of the department of public safety or a designee;
(3) The director of the department of conservation or a designee; and
(4) The chief engineer of the department of transportation or a designee.
3. The committee shall examine existing programs and proposals for development or expansion to identify duplication in resource allocation of wireless communication systems. The committee shall submit a report to the general assembly by August 30, 1998, in which it identifies opportunities for cost savings, increased efficiency and improved services for Missouri's citizens. The committee shall review the state's purchasing law and may recommend such changes to chapter 34, RSMo, as it deems appropriate to maintain and enhance the state's wireless communication system. The committee may make such other recommendations as it deems appropriate and shall identify the costs associated with each such recommendation.]
