AN ACT

To amend chapter 266, RSMo, by adding thereto one new section relating to private investigations for farm commodities.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 266, RSMo, is amended by adding thereto one new section, to be known as section 266.127, to read as follows:

            266.127. 1. No private entity shall be authorized to enter onto any private property in this state to determine or verify the origin or source of a farm commodity, or to enforce any provisions of any trade agreements or contracts of the private entity associated with the use of a genetically-modified organism agricultural product without prior actual notification to the landowner and the appropriate local law enforcement agency.

            2. Nothing in this section shall be construed as providing a landowner or local law enforcement with the right to refuse such entry if such entry is otherwise lawful under state or federal law.

            3. Any private entity that violates the provisions of this section is guilty of trespass and shall be subject to a fine of not less than ten thousand dollars for each violation.
