AN ACT

To amend chapter 302, RSMo, by adding thereto one new section relating to school bus driver endorsements.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 302, RSMo, is amended by adding thereto one new section, to be known as section 302.278, to read as follows:

            302.278. 1. No school bus driver employed by a school district or under contract with a school district shall use or otherwise operate a cellular phone while driving a school bus that is transporting a child or children.

            2. Any school bus driver who violates the provisions of this section shall be subject to the following as follows:

            (1) For a first violation, a twenty-five dollar fine;

            (2) For a second violation, suspension of his or her school bus endorsement for a period of ten days; and

            (3) For any third or subsequent violation, revocation of his or her school bus endorsement.

 

Any person who operates a school bus, as defined in section 301.010, RSMo, after having the person's permit suspended or revoked under this section shall be punished in accordance with section 302.321.
