AN ACT
To amend chapter 577, RSMo, by adding thereto one new section relating to taking wildlife on any public roadway from a motor-driven conveyance, with a penalty provision.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 577, RSMo, is amended by adding thereto one new section, to be known as section 577.165, to read as follows:
577.165. 1. No person shall use a firearm, as defined in section 571.010, RSMo, or a crossbow to pursue, take, attempt to take, or molest wildlife from a motor-driven conveyance on any public roadway.
2. Any person violating this section shall be guilty of a misdemeanor, except that any person charged under this section who has previously plead guilty to or has been found guilty of one or more violations of this section shall be deemed guilty of a felony and upon conviction shall be punished by imprisonment in the penitentiary for a term not exceeding two years, or by imprisonment in the county jail for a term not exceeding twelve months, or by a fine of one thousand dollars, or by both such fine and imprisonment.
