AN ACT
To amend chapter 236, RSMo, by adding thereto one new section relating to use and occupancy restrictions for structures on lands and waters of certain hydroelectric projects.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 236, RSMo, is amended by adding thereto one new section, to be known as section 236.360, to read as follows:
236.360. 1. If any private entity licensed by the Federal Energy Regulatory Commission for operation of a hydroelectric project or projects on the Lake of the Ozarks imposes any boat dock fee or charge based on the square footage of a boat dock located on such project lands and waters, such square footage shall be calculated based on the total square footage of the surface area of the boat dock minus the square footage of the surface area of all slips in the boat dock.
2. Any private entity subject to the provisions of subsection 1 of this section that violates the provisions of this section shall be liable to the person or entity paying such fee or charge for three times the amount overpaid.
