AN ACT
To amend chapter 236, RSMo, by adding thereto one new section relating to use and occupancy restrictions for structures on lands and waters of certain hydroelectric projects, with an emergency clause.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 236, RSMo, is amended by adding thereto one new section, to be known as section 236.350, to read as follows:
236.350. No private entity licensed by the Federal Energy Regulatory Commission for operation of a hydroelectric project or projects on the Lake of the Ozarks shall deny a noncommercial use and occupancy permit for a boat dock on property located in an impact minimization zone or part of a shoreline preservation program established and implemented by the private entity because of the lack of a distance greater than twenty-five feet between boat docks or otherwise restricts the construction, maintenance, or expansion of a boat dock to be located on such project lands and waters based solely on such distance restriction.
Section B. Because immediate action is necessary to protect the real property interests of the citizens of this state, section A of this act is deemed necessary for the immediate preservation of the public health, welfare, peace, and safety, and is hereby declared to be an emergency act within the meaning of the constitution, and section A of this act shall be in full force and effect upon its passage and approval.
