AN ACT
To amend chapter 320, RSMo, by adding thereto one new section relating to the licensing of fire sprinkler installers.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 320, RSMo, is amended by adding thereto one new section, to be known as section 320.051, to read as follows:
320.051. 1. As used in this section, the following terms mean:
(1) "Director", the director of the division of professional registration;
(2) "Fire sprinkler installer contractor", a person who has a level three certificate in fire protection/automatic fire sprinkler systems layout from the National Institute for Certification in Engineering Technology and has successfully passed an examination required by the division of professional registration or who has been licensed as a fire sprinkler installer for the last three years, accumulating a minimum of three thousand hours of work experience in that same period, and who has successfully passed the test required by the division of professional registration;
(3) "Fire sprinkler installer", a person who works under the direction of a fire sprinkler installer contractor and who has successfully completed a five-year federally registered apprenticeship program and is engaged in the practical installation, inspecting, testing, dismantling to terminate service, maintenance, and repair of fire sprinkler systems and has successfully passed the examination required by the division of professional registration;
(4) "Fire sprinkler installer assistant", any person who is engaging in learning and assisting in the installation, testing, inspecting, dismantling to terminate service, maintenance, and repair of fire sprinkler systems under the direct supervision of a licensed fire sprinkler installer or contractor and who is enrolled in a five-year federally registered apprenticeship program.
2. No person shall install, inspect, dismantle for the purposes of terminating service, maintain, or repair any fire sprinkler system unless he or she is licensed by the division of professional registration. No fire sprinkler installer contractor or fire sprinkler installer shall have more than one fire sprinkler installer assistant under his or her supervision at one time.
3. The director shall promulgate rules to implement the provisions of this section and to establish the procedures for licensing fire sprinkler installer contractors, fire sprinkler installers, and fire sprinkler installer assistants. These regulations shall include but not be limited to establishing licensing procedures, fees, examinations, and causes for suspension and revocation of licenses. Any rule or portion of a rule, as that term is defined in section 536.010, RSMo, that is created under the authority delegated in this section shall become effective only if it complies with and is subject to all of the provisions of chapter 536, RSMo, and, if applicable, section 536.028, RSMo. This section and chapter 536, RSMo, are nonseverable and if any of the powers vested with the general assembly under chapter 536, RSMo, to review, to delay the effective date, or to disapprove and annul a rule are subsequently held unconstitutional, then the grant of rulemaking authority and any rule proposed or adopted after August 28, 2006, shall be invalid and void.
4. The provisions of this section shall not apply to any municipal, county, or state employee in the performance of his or her duties or anyone licensed as an engineer in this state.
