Summary of the Committee Version of the Bill

HCS#2 HB 28 -- CARRIERS OF HOUSEHOLD GOODS

SPONSOR: Cunningham (86)

COMMITTEE ACTION: Voted "do pass" by the Special Committee on
Energy and Environment by a vote of 9 to 0.

This substitute allows a common carrier of household goods to
file an application with the Highways and Transportation
Commission for approval of rates to reflect increases and
decreases in the carrier's cost. The filing of the application
will follow similar rules that govern rate adjustments requested
by electrical, gas, or water companies. The commission will
determine the form in which the application is to be made.

Beginning January 1, 2008, motor carriers that transport
household goods will be prohibited from operating wholly in
municipalities, between contiguous municipalities, or in
commercial zones without obtaining authority from the Department
of Transportation. Currently, household carriers are exempt from
the rules and regulations of Chapter 390, RSMo, if their
operations are restricted to those described areas.

FISCAL NOTE: No impact on General Revenue Fund in FY 2008,
FY 2009, and FY 2010. Estimated Income of Unknown in FY 2008,
FY 2009, and FY 2010.

PROPONENTS: Supporters say that the bill will allow in-state,
Missouri moving companies to compete on a level playing field
with out-of-state companies. Moving companies will still be
subject to regulation, but rate adjustments will be allowed for
in-state companies just as they are allowed for interstate moving
companies.

Testifying for the bill were Representative Cunningham (86);
Harold Williams; Michael Duncan; and Bill Neil.

OPPONENTS: There was no opposition voiced to the committee.
