HB 762 -- Disclosure of News Media Information

This bill establishes the Premature or Unnecessary
Subpoena Prevention Act which prohibits any judicial,
legislative, administrative, or other official body to compel a
member of the news media to disclose information that has not
been published or broadcast.  The party requesting the
information may compel disclosure of the information only after
establishing by clear and convincing evidence that:

(1)  The information is highly relevant to a legal issue before
any official body;

(2)  The information is critical to the maintenance of the
requesting party's legal claim or defense; and

(3)  The requesting party has not been able to obtain the
information from any alternative sources after a full and
diligent attempt.
