HB 866 -- Tow Truck Operations Sponsor: Guest This bill establishes the Emergency Responders Safety Act which provides for the licensing and regulation of tow truck businesses and operators. Tow truck operators will be required to be licensed by the Department of Revenue. The qualifications for a person to obtain a license will include, but are not limited to, being a United States citizen, being at least 21 years of age, having a good understanding of federal and state laws relating to tow truck operation, and completing an approved tow truck training course. A tow truck license will be for a three-year period, and the fee will be no more than $100. To renew this license, a person must complete an eight-hour course of continuing training approved by the department. A tow truck license may be suspended or revoked by the department. The Emergency Responders Safety Board is established within the department consisting of five members appointed by Governor, with the advice and consent of the Senate. Terms of the board members will be for six years and will be staggered. The board will: (1) Advise the department in the development of application and registration forms, training and examination, and the establishment of fees for the filing of required applications, registrations, and reports; (2) Approve or disapprove any application for the licensing of tow truck operators; (3) Hold hearings and make decisions upon appeals; (4) Approve or disapprove any rule proposed by the department; and (5) Advise or assist the department in any matter regarding the administration or enforcement of the provisions of the bill. The Missouri Emergency Responders Safety Act Administration Fund is created which will consist of all fees associated with the licensure of tow truck operators, appropriations from the General Assembly, federal grants, and private donations. Moneys in the fund will be used solely for the administration of tow truck licensing provisions.Copyright (c) Missouri House of Representatives
