HB 946 -- Electrical Corporation Requirements

This bill requires the Missouri Public Service Commission to
develop minimum standards by January 1, 2008, for electrical
service, infrastructure maintenance, and vegetation management.
The commission must not approve rate increases if a utility is in
violation of any of these standards and must require utilities to
reimburse customers for loses of $200 or more resulting from
violations of the reliability standards.

The commission is authorized to enforce its standards by
administrative penalty provisions with a maximum allowable
penalty of $250,000 per day per violation.  A process for
adjudicating penalties or reaching agreements to correct
violations without assessing penalties is specified in the bill.
Penalties must be assessed within two years of the violation or
the date when the commission should reasonably have discovered
the violation.
