AN ACT

To amend chapter 191, RSMo, by adding thereto one new section relating to ethical vaccines.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 191, RSMo, is amended by adding thereto one new section, to be known as section 191.1000, to read as follows:

            191.1000. 1. As used in this section, the term "ethical vaccine" means any vaccine that is not produced using any cell culture derived from an aborted fetus.

            2. Beginning January 1, 2008, the state of Missouri shall not purchase or pay for any vaccine that is not an ethical vaccine; except that, if there is no ethical vaccine available for a particular disease or condition, a vaccine that does not meet the definition of ethical vaccine in this section may be used.

            3. After January 1, 2010, the state of Missouri shall not purchase or reimburse for any vaccine unless it is an ethical vaccine.

            4. Any parent or legal guardian of a child and any adult given a vaccine that is not an ethical vaccine shall be informed that the vaccine was manufactured using a cell culture derived from an aborted fetus.

            5. Any person may refuse to receive a vaccine based on a religious objection, including but not limited to any objection on the grounds that there is no ethical vaccine available for a specific disease or condition.
