AN ACT

To amend chapter 162, RSMo, by adding thereto one new section relating to teacher transfers in failing districts.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 162, RSMo, is amended by adding thereto one new section, to be known as section 162.1197, to read as follows:

            162.1197. 1. The superintendent of a school district that is provisionally accredited or unaccredited may not transfer a teacher who requests to be transferred to a school if the principal of the receiving school refuses the transfer.

            2. The governing board of a school district that is provisionally accredited or unaccredited may not adopt a policy that assigns, after April fifteenth of the school year prior to the school year in which the transfer would become effective, priority over other qualified applicants who have applied for positions at the school to a teacher who requests to be transferred to another school.
