AN ACT

To repeal section 389.615, RSMo, and to enact in lieu thereof one new section relating to rail-highway grade crossings.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Section 389.615, RSMo, is repealed and one new section enacted in lieu thereof, to be known as section 389.615, to read as follows:

            389.615. The multimodal division of [motor carrier and railroad safety] the department of transportation shall conduct a study to establish priorities for [grade crossing closures and a plan for implementing grade crossing closures] the placement of median barriers at rail-highway grade crossings by listing the top ten percent of all public rail-highway crossings in the state with both the most train traffic and the most motor vehicle traffic as of January 1, 2008, and shall issue recommendations for implementing median barrier installations where appropriate. The study [is to be completed by January 1, 1994] and recommendations shall be completed by January 1, 2009, and is not to be paid for from the grade crossing safety account. To promote the safety of railroad tracks at crossings, the division may employ additional [track] railroad safety specialists, subject to appropriations, or available federal or private funding. No less than fifty percent of the cost of the median barriers and installation shall be allocated to the railroad. All median barrier installations under this section shall be completed no later than January 1, 2015.
