AN ACT
To amend chapter 163, RSMo, by adding thereto one new section relating to school funding for prisoners in state custody.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 163, RSMo, is amended by adding thereto one new section, to be known as section 163.165, to read as follows:
163.165. 1. Beginning January 1, 2008, and every year thereafter, the director of the department of corrections, the commissioner of education, and the commissioner of administration shall determine:
(1) The average daily cost of maintaining a prisoner in state custody; and
(2) The number of prisoners whose last attended Missouri school district was a metropolitan district or an urban district containing the greater part of a home rule city with more than four hundred thousand inhabitants and located in more than one county.
The average daily cost and the number of prisoners meeting the description above agreed upon shall be used to determine a deduction from the school state aid of the affected district for the upcoming fiscal year under subsection 2 of this section.
2. The department of elementary and secondary education shall have all the necessary power and authority to make the deductions from a district's state school aid apportionment that result from multiplying the number of prisoners in the affected districts by the average cost as derived under subsection 1 of this section and to transfer the calculated amount to the department of corrections.
