AN ACT

To amend chapter 324, RSMo, by adding thereto one new section relating to fire sprinkler installer contractors.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 324, RSMo, is amended by adding thereto one new section, to be known as section 324.1275, to read as follows:

            324.1275. 1. As used in this section, the following terms mean:

            (1) "Director", the director of the division of professional registration;

            (2) "Fire sprinkler installer", a person who:

            (a) Works under the direction of a fire sprinkler installer contractor; has successfully completed a five-year federally registered apprenticeship program; is engaged in the practical installation, inspection, testing, dismantling to terminate service, maintenance, and repair of fire sprinkler systems; and has successfully passed an examination demonstrating proficiency as required by the director; or

            (b) Has been working as a fire sprinkler installer for at least five years of the last preceding seven, accumulating at least five thousand hours of work experience in the same period, and has successfully passed an examination demonstrating proficiency as required by the director;

            (3) "Fire sprinkler installer assistant", a person who is engaged in learning and assisting in the installation, testing, inspecting, dismantling to terminate service, maintenance, and repair of fire sprinkler systems under the direct supervision of a licensed fire sprinkler installer or contractor and who is enrolled in a five-year federally registered apprenticeship program;

            (4) "Fire sprinkler installer contractor", a person who:

            (a) Has a level three certificate in fire protection/automatic fire sprinkler system layout from the National Institute for Certification in Engineering Technology (NICET) and has successfully passed an examination demonstrating proficiency as required by the director; or

            (b) Has been working as a fire sprinkler installer contractor for the last three years accumulating a minimum of three thousand hours of work experience in the same period of time and who has successfully passed an examination demonstrating proficiency as required by the director.

 

All fire sprinkler installer contractors shall utilize a NICET Level Three designer or engineer in the design of their fire sprinkler systems.

            2. No person shall install, inspect, test, dismantle to terminate service, maintain, or repair any fire sprinkler system unless he or she is licensed by the division of professional registration. This license requirement shall become effective one year following the first examinations given by the division of professional registration in order to allow a reasonable period of time to establish an adequate licensed work force.

            3. No fire sprinkler installer contractor shall employ more fire sprinkler installer assistants than fire sprinkler installers.
