AN ACT
To amend chapter 160, RSMo, by adding thereto one new section relating to education renewal commissions.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 160, RSMo, is amended by adding thereto one new section, to be known as section 160.645, to read as follows:
160.645. 1. Upon a declaration by the state board of education that a district with more than ten thousand students is unaccredited an education renewal commission for such district shall be appointed within thirty days. The commission shall consist of one house member appointed by the speaker of the house of representatives, one house member appointed by the minority floor leader of the house of representatives, one senate member appointed by the president pro tem of the senate, one senate member appointed by the minority floor leader of the senate, four parents of children who attend school in the school district to be appointed by the mayor, one representative of the business community to be appointed by the mayor, one teacher employed by the school district to be appointed by the mayor, one member of the school board to be appointed by the school board, and one representative of the department of elementary and secondary education to be appointed by the commissioner of education. The members shall not be compensated but shall receive their actual and necessary expenses for participation on the commission. The commission shall be funded through and supported by the department of elementary and secondary education.
2. The commission, or upon the reestablishment of a transitional district under section 162.1100 the special administrative board or transitional district board shall develop a plan to divide the school district into a minimum of five new districts and provide boundaries for such new districts. The plan shall be developed and implemented by the date of lapse if the plan is drawn by an educational renewal commission or by the opening date of the next school year after the date of lapse in the case of a plan drawn by a special administrative board or transitional district board.
3. Upon implementation of the plan, the school district shall continue to exist only for the purposes of assessing, collecting, and distributing property taxes. The commission or board, as appropriate, shall develop a plan and determine the distribution of such taxes equitably on a per pupil basis. The commission or board shall suggest a plan for using the new districts for tax purposes.
4. The commission or board, as appropriate, may sponsor charter schools within the school district if charters are otherwise permitted under section 160.400.
5. The commission or board, as appropriate, shall provide a transportation plan for the school districts.
6. Students in the school district may attend any district created under this section.
