AN ACT

To amend chapter 168, RSMo, by adding thereto one new section relating to teacher testing.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 168, RSMo, is amended by adding thereto one new section, to be known as section 168.375, to read as follows:

            168.375. 1. Every certificated teacher shall, in the fifth year following initial certification and every fifth year thereafter, submit documentation to the department of elementary and secondary education that the teacher has:

            (1) Retaken the appropriate exit assessment under section 168.021 and achieved a score equal to or higher than the required score;

            (2) Taken the four academic core area assessments of the statewide assessment program under section 160.518, RSMo, at the high school level and achieved the advanced level if the teacher's assignment is in any grade from kindergarten through eighth grade, or the communication arts and mathematics assessments if the teacher's classroom assignment is ninth grade or higher, and the social studies or science assessment if applicable, and achieved at the advanced level on such assessments; or

            (3) Successfully completed any course or examination determined by rule of the state board of education for this purpose.

            2. A certificated teacher who has failed to achieve the required score on the chosen assessment under subsection 1 of this section may retake the assessment at the next available date. If a teacher fails a second time, or wishes to appeal after an initial failure, the teacher shall present documentation of effectiveness such as student test scores on a value-added instrument advancing, on average, by one grade level. The appeal shall be made through the administrative hearing commission under Chapter 621.
