AN ACT

To amend chapter 302, RSMo, by adding thereto one new section relating to identification for veterans.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 302, RSMo, is amended by adding thereto one new section, to be known as section 302.188, to read as follows:

            302.188. 1. Beginning on January 1, 2013, a person may apply to the department of revenue to obtain a sticker indicating veteran status to be applied to the person's driver's license or identification card issued under this chapter. Persons seeking such designation shall submit to the department of revenue a document, provided by the Missouri Veterans Commission, attesting that the applicant has been credited with service in the armed forces of the United States and that the applicant's status upon discharge was honorable or general under honorable conditions.

            2. The Missouri Veterans Commission shall develop the criteria for determining whether an applicant is eligible to receive the veteran designation on a driver's license or identification card authorized under this chapter. 

            3. The director of revenue shall:

            (1) Determine the appropriate fee, placement, and style of the sticker to be placed on the driver's licenses and identification cards authorized under this section; and

            (2) Promulgate all rules and regulations, consistent with the criteria developed by the Missouri Veterans Commission, necessary for the implementation and administration of the provisions of this section.

            4. Any rule or portion of a rule, as that term is defined in section 536.010 that is created under the authority delegated in this section shall become effective only if it complies with and is subject to all of the provisions of chapter 536 and, if applicable, section 536.028. This section and chapter 536 are nonseverable and if any of the powers vested with the general assembly pursuant to chapter 536 to review, to delay the effective date, or to disapprove and annul a rule are subsequently held unconstitutional, then the grant of rulemaking authority and any rule proposed or adopted after August 28, 2012, shall be invalid and void.
