AN ACT

To amend chapter 376, RSMo, by adding thereto one new section relating to emerging issues in cancer medications.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 376, RSMo, is amended by adding thereto one new section, to be known as section 376.1257, to read as follows:

            376.1257. 1. For purposes of this section, the following terms shall mean:

            (1) “Chemotherapy”, drugs and biologics that are used to kill, slow, or prevent the growth of cancerous cells;

            (2) “Health benefit plan”, the same meaning ascribed to such term in section 376.1350.

            2. Any health benefit plan that covers injected or intravenously administered chemotherapy and orally administered chemotherapy shall not require a higher co-payment, deductible, or coinsurance amount for oral chemotherapy than it requires for injected or intravenous chemotherapy, regardless of the formulation or benefit category determination by the plan.

            3. The health benefit plan shall not comply with subsection 2 of this section by increasing the co-payment, deductible, or coinsurance amount required for injected or intravenous chemotherapy that is covered under the plan.
