AN ACT
To amend chapter 162, RSMo, by adding thereto one new section relating to unaccredited school district board members, with an emergency clause.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 162, RSMo, is amended by adding thereto one new section, to be known as section 162.045, to read as follows:
162.045. 1. The board of education of each district in this state that does not maintain an accredited school under the authority of the state board of education to classify schools as established under section 161.092 shall be immediately dissolved at the time of the loss of accreditation, and each member shall be relieved of his or her duties as a board member.
2. Within forty-five days of the loss of accreditation, a special election shall be held to elect new members of the district’s school board. Any costs associated with the special election shall be paid for by the unaccredited school district.
3. Any person who is subject to the provisions of subsection 1 of this section shall not be eligible to file as a candidate to serve as a school board member for any school district in this state for a period of eight years from the date of the loss of accreditation unless that person served on the school board for a period of less than eighteen months prior to the loss of accreditation by the school district.
Section B. Because immediate action is necessary to ensure that each school district in the state has a properly functioning board of education the repeal and reenactment of section A of this act is deemed necessary for the immediate preservation of the public health, welfare, peace, and safety, and is hereby declared to be an emergency act within the meaning of the constitution, and the repeal and reenactment of section A of this act shall be in full force and effect upon its passage and approval.
