AN ACT

To amend chapter 537, RSMo, by adding thereto one new section relating to immunity for sheriffs and their employees in certain circumstances.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 537, RSMo, is amended by adding thereto one new section, to be known as section 537.900, to read as follows:

            537.900. No cause of action shall be made against a sheriff, a deputy sheriff, or an administrative employee of a sheriff when the actions complained of were made in furtherance of or in compliance with a court order or directive, even if the order or directive executed is later determined to be invalid by a court of competent jurisdiction. A cause of action for damages may be brought against the party who obtained the court's order or directive if obtained by way of fraud or false statement. If such an action is filed against a sheriff, a deputy sheriff, or an administrative employee of a sheriff, all costs incurred for the defense of the action by or on behalf of the sheriff, deputy sheriff, or administrative employee shall be taxed to the petitioner.
